GYG: Existing Use Rights Tested at Parklea

A development proposal has been lodged to establish a Guzman y Gomez drive-thru restaurant at 484 Sunnyholt Road in Parklea, relying on existing use rights within a residential zone.  

The 8,636 sqm site is zoned R2 Low Density Residential, where drive-thru restaurants are not permitted. However, the land contains a highway service centre approved in 2007 under the former planning controls, including a Shell service station and Red Rooster drive-thru.

The proposal seeks approval for a 202 sqm 24/7 drive-thru. The building would provide seating for 34 patrons, supported by a single lane drive-thru with queuing capacity for 15 vehicles.  

32 car spaces are allocated to the tenancy, contributing to the 72 spaces across the broader site.  

Fourteen trees would be removed for the PAD site. Acoustic fencing, odour control systems and mechanical exhaust treatment form part of the mitigation package given the immediate residential interface.
